Pedestrian fatalities on the rise
Sadly, pedestrian fatalities keep going up each year. In 2019, that number rose to 6,590, which is the highest it has been in over 30 years. According to a report from the Governors Highway Safety Association, pedestrian fatalities have increased by 50% in the last 10 years.
Most traffic fatalities involving pedestrians occur at night or in the early morning on local roads and away from intersections. Unsafe driving practices such as speeding, drowsy or distracted driving, increase risks to pedestrians walking along the berm or crossing a road. In 2018, alcohol impairment of the driver or pedestrian accounted for nearly half of car wrecks resulting in pedestrian fatalities.
Negligence in Georgia
Atlanta is a city known for its greenery, which is a plus for city dwellers who love walking and biking through its beautiful neighborhoods. It is also a city known for its heavy traffic, and pedestrians take risks every time they step foot onto a roadway, even if they are in the crosswalk.
Georgia recognizes contributory negligence, which means that even if the injured party was found to be partially responsible for causing the accident, they can still file a claim as long as their contribution to the accident was less than 50%.
When a pedestrian has suffered catastrophic injuries due to the negligence of a driver, it is essential to know where find committed and aggressive legal representation in a negligence suit. Some injuries might involve lengthy hospital stays, surgeries and prolonged rehabilitation. It is essential to fight for the compensation you deserve for your injuries.
